1 Definitions
In these Terms and Conditions:
- “Company”, “we”, “us” means Ishasha Women's Community Tours and Travel, of Ishasha Highway, Kihihi, Uganda.
- “Client”, “you” means the person or persons making a booking and all members of their party.
- “Tour” or “Services” means any tour, safari, trek, transfer, or related service arranged by the Company.
- “Booking” means a confirmed reservation for which a deposit or full payment has been received and written confirmation issued.
2 Booking Process & Contract
2.1 How a contract is formed
A binding contract is formed when (a) you submit a booking request, (b) we receive the required deposit (or full payment), and
(c) we issue written confirmation by email or other official channel. Until then, prices and availability are not guaranteed.
2.2 Accuracy of information
You must provide accurate names, contact details, passport information (where required), dietary needs, and any medical or
accessibility requirements at the time of booking. The Company is not responsible for losses arising from incorrect information supplied by you.
2.3 Who may book
By booking, you confirm that you are at least 18 years of age and have authority to accept these Terms on behalf of all members of your party.
You are responsible for ensuring that every member of your party is aware of and complies with these Terms.
2.4 Payment
Payment terms, deposits, balances, cancellation fees, and refunds are governed by our
Payment Policy,
which forms part of these Terms.
3 Client Responsibilities
- Hold a valid passport and any visas, permits, or entry requirements for the countries visited. The Company can advise but is not responsible for obtaining visas on your behalf unless expressly agreed in writing.
- Comply with all local laws, park regulations, and instructions given by guides, rangers, and Company staff.
- Inform the Company of any medical condition, disability, pregnancy, or special need that may affect participation in activities (e.g. gorilla trekking, hiking, boat trips).
- Behave in a manner that does not endanger yourself, other clients, wildlife, or staff.
- Arrive on time for pick-ups, briefings, and activities. The Company is not obliged to delay departures for late clients and is not liable for missed services due to lateness.
- Carry adequate personal medication, suitable clothing, and equipment as advised in pre-departure information.
Age & fitness: Some activities (including gorilla and chimpanzee trekking) have minimum age limits and require a reasonable level of fitness.
The Company may refuse participation if, in its reasonable opinion, a client is unfit or underage for the activity. No refund applies in such cases if the limitation was disclosed before booking.
4 Company Responsibilities
- Provide the services described in the confirmed itinerary with reasonable care and skill.
- Use competent guides and suitable vehicles and equipment where these form part of the package.
- Inform you of significant changes to the itinerary as soon as reasonably possible.
- Handle personal data in accordance with applicable law and our privacy practices.
4.1 Itinerary changes
Wildlife, weather, park conditions, and logistics in East Africa can require changes. The Company reserves the right to alter routes,
accommodation, or schedules where necessary for safety or operational reasons. We will endeavour to provide services of equivalent standard.
Minor changes do not entitle you to cancel or claim a refund.
4.2 Third-party suppliers
Accommodation, flights, park authorities, and some activities are provided by independent third parties.
The Company acts as an organiser and will assist in resolving issues, but is not liable for acts or omissions of third parties beyond its reasonable control.
5 Liability & Assumption of Risk
5.1 Inherent risks
Adventure travel, wildlife viewing, trekking, and related activities involve inherent risks, including injury, illness, property loss, or death.
By participating, you acknowledge and accept these risks.
5.2 Limitation of liability
- To the maximum extent permitted by law, the Company’s total liability for any claim arising out of a booking shall not exceed the total amount paid by you to the Company for that booking.
- The Company is not liable for indirect, incidental, or consequential losses (including loss of enjoyment, pure economic loss, or missed onward travel) except where caused by the Company’s gross negligence or wilful misconduct.
- Nothing in these Terms excludes or limits liability for death or personal injury caused by the Company’s negligence, or for fraud, where such exclusion is prohibited by law.
5.3 Force majeure
The Company is not liable for failure or delay in performing obligations due to events beyond its reasonable control, including natural disasters,
war, terrorism, civil unrest, epidemics, government actions, park closures, strikes, or severe weather. In such cases, our
Payment Policy on force majeure and credits/refunds applies.
6 Travel Insurance
Strongly recommended: All clients should obtain comprehensive travel insurance covering cancellation, medical treatment and evacuation,
personal accident, and baggage for the full duration of the trip, including adventure activities where applicable.
The Company does not provide travel insurance. Proof of insurance may be requested before certain high-risk activities.
Failure to hold adequate insurance is at your own risk.
7 Conduct & Right to Refuse Service
The Company may refuse to allow a client to start or continue a tour, without refund, if the client:
- Is under the influence of alcohol or drugs in a way that endangers safety or enjoyment of others;
- Behaves in an abusive, discriminatory, or illegal manner;
- Persistently ignores safety instructions from guides or park authorities;
- Is found to have provided false information material to the booking.
8 Health & Safety
- You are responsible for consulting a medical professional regarding vaccinations, malaria prophylaxis, and fitness for travel.
- In remote areas, medical facilities may be limited. Evacuation can be costly; insurance covering medical evacuation is essential.
- The Company follows park and government safety guidelines. You must follow all guide and ranger instructions, especially near wildlife.
9 Photography & Marketing
During tours, staff or partners may take photographs or video. By participating, you grant the Company a non-exclusive right to use such images
for marketing and promotional purposes (website, social media, brochures), unless you notify us in writing before the tour that you do not consent.
You retain ownership of photos you take yourself.
10 Complaints
If you have a problem during the tour, please raise it immediately with your guide or our office so we can attempt to resolve it on the spot.
Formal complaints after the tour should be submitted in writing to
ishashawomenscommunity2023@gmail.com
within 28 days of the end of the tour. We will acknowledge and investigate in good faith.
11 Governing Law & Disputes
These Terms are governed by the laws of the Republic of Uganda.
The parties shall first attempt to resolve any dispute amicably. If unresolved, disputes may be submitted to the competent courts of Uganda,
without prejudice to mandatory consumer protection rights that may apply in your country of residence.
12 General
- If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
- These Terms, together with the confirmed itinerary and Payment Policy, constitute the entire agreement between you and the Company regarding the booking.
- The Company may update these Terms from time to time. The version in force on the date of your booking confirmation applies to that booking.
